An order is only considered accepted once we confirm it, and confirmation requires that we have successfully received and processed your payment. By submitting an order, you confirm that: (i) any payment information you provide is true and accurate; (ii) you are authorized to use the chosen payment method; (iii) charges made using that payment method will be honored by your bank or card issuer; and (iv) you agree to pay all applicable charges, including taxes and shipping fees, at the prices posted at checkout.

Section 5 — Shipping and Delivery

While we work with reliable carriers to fulfill orders, all delivery timelines provided are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs authorities, or other circumstances beyond our reasonable control. Once a product has been handed over to the carrier, responsibility for and risk of loss or damage to that product transfers to you.

Section 6 — Intellectual Property

All content made available through the Services — including trademarks, brand names, text, graphics, images, product photography, reviews, video, and audio, as well as the overall design, selection, and arrangement of this content — is owned by Bharti Home of Wellness, our affiliates, or our licensors, and is protected under applicable copyright, trademark, and other intellectual property laws.

Our brand name, logo, and any associated marks or slogans belong to Bharti Home of Wellness and may not be used without our prior written permission. Shopify's name, logo, and related marks belong to Shopify. All other trademarks appearing on the Services belong to their respective owners.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BHARTI HOME OF WELLNESS, ITS OWNERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, AND SERVICE PROVIDERS, AS WELL AS SHOPIFY AND ITS AFFILIATES, SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES — INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS — ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend, and hold harmless Bharti Home of Wellness, Shopify, and each of our respective affiliates, officers, directors, employees, agents, and service providers from any claims, damages, liabilities, or expenses — including reasonable legal fees — arising from: (1) your breach of these Terms of Service; (2) your violation of any law or the rights of a third party; or (3) your use of or access to the Services.

We will make reasonable efforts to notify you of any claim subject to indemnification; however, a delay in notice will not relieve you of your obligations unless it materially prejudices your defense. We reserve the right to control the defense and settlement of any such claim at your expense, though we will not settle any claim requiring a non-monetary obligation from you without your consent. You agree to cooperate fully in the defense of any such claim.

If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms of Service, together with any policies referenced herein, represent the entire agreement between you and Bharti Home of Wellness regarding your use of the Services, and supersede any prior agreements or communications, whether written or oral. Any ambiguity in interpretation will not be construed against the drafting party.

These Terms of Service, and any separate agreements under which we provide you with Services, are governed by and interpreted in accordance with the applicable laws of the jurisdiction in which Bharti Home of Wellness is based. You agree to submit to the personal jurisdiction and venue of the courts located in that jurisdiction.
